MICHELLE – just to clarify, it’s only *homosexuality* between consenting adults that has been *decriminalised* – according to an old Victorian law, any kind of non-vaginal sex, including that between consenting same-sex couples, was punishable by imprisonment. Section 377 also covers pedophilia and non-consensual, non-vaginal sex, but was also used to harass gay couples. The major victory has been to *legally* remove consensual non-heterosexual, and non-vaginal sex from its ambit. The legal right to marriage, or civil unions for same-sex couples, or social acceptance for such couples and unions are still a far cry… As MEL points out, it’s a small, but very significant first step.

My understanding is that this ruling only applies to the Capital Territory at the moment, though, and that it will require some broader action to extend it to the nation at large. Still, it’s quite a landmark case and a very long time in coming.

well said. the whole idea of decriminalising homosexuality is not to propagate it or say that it would destroy indian culture. the idea is that two consenting adults can have a consensual relationship in private without fear or interference from the state similar to couples in heterosexual relationships. so it is about equal rights and a recognition that every one is different.
